Poll: Supreme Court Correct in Upholding Health Care Act?
The 5-4 decision written by Chief Justice John Roberts found that Congress was not acting outside the Constitution when it mandated that all individuals buy health insurance.
The Affordable Care Act has been upheld by the highest court in the land, according to the Supreme Court of the United States Blog sponsored by Bloomberg Law.
The decision written by Chief Justice John Roberts found that Congress was not acting outside the Constitution when it mandated that all individuals buy health insurance, however the justices ruled that Congress cannot penalize states for not participating.
From the decision: “Nothing in our opinion precludes Congress from offering funds under the ACA to expand the availability of health care, and requiring that states accepting such funds comply with the conditions on their use. What Congress is not free to do is to penalize States that choose not to participate in that new program by taking away their existing Medicaid funding."
Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagen joined Roberts in the majority. Justices Samuel Alito, Clarence Thomas, Anthony Kennedy and Antonin Scalia formed the minority.

It is a sad day. This country was fought for INDEPENDENCE. That independence is slowly slipping further and further from us. Our Government needs to go back to what the Constitution was founded on. We are going backwards not forward if we keep running this country the way it is.

I am very upset at this decision, and I have said, if they held this horrible decision up, then we are DOOMED, and so we ARE DOOMED for our future, for my parents, my generation and the generations to come, We cannot overcome all the rights that have already been taken away from us, and NOW MORE TO COME!! Mark it down, as a country, we are DOOMED!!!

There is no limit to the federal government. Once it was decided that it was ok to take your home "for the better good" there was no limit to what could be done.

I for one am pleased to see this decision...I'm frankly tired of paying higher and higher healthcare premiums because of people who fail to buy coverage and then just show up in the emergency room with the flu because they can't just go to a doctor. All the people out there saying we shouldn’t force people to buy insurance ought to tell me why as a responsible person should HAVE to pay for others who choose not to spend the money on insurance? Do you not think there are not other things I’d like to do with the hundreds of dollars it cost to have health insurance for my family? I agree 100% with the ruling; if you don’t want to buy insurance fine, but guess what you can pay a tax penalty into a fund that keeps me from paying for you every time you get sick or hurt!

The supreme irony here? Judge Roberts was the deciding vote and he was appointed by George Bush and Republican controlled Congress.

Obviously, Faux news lives on Powder Springs....the most uninformed and incorrect way to get the news. Thank God more people will have the chance to accessible health care. America does not have the best health care system in the world and we pay more and get less. Maybe we can finally move towards better health care for all. FYI - there are no such things as "death panels". It simply allows your physician to discuss all your health options and spend some time talking with the patient as to what are the PATIENT'S wishes.

My two cents here: Yes, we need healthcare reform..badly. Is ANOTHER tax the answer: NO! Do a little research and see how much the average American Taxpayer will be expected to pony up to cover these folks. There has got to be a better way.

It is not for the feds to tell me, us what We have to buy! I chose not to buy insurance and that is my right! Get it! If you think it's okay for the feds to tell you what you can and can not buy you are sadly mistaken! Read The Constitution! You people want a socialist government, there are plenty of other countries to accomodate you. If you think for one minute you are going to have controll of your health care, you are sadly mistaken. You better read this bill! There are doctors you can go to without going to the ER. Use some common sense. Just because you have no insurance does not mean you just go to the ER. Take resposibilty and find a doctors office with reasonable fees. They are out there!

I'm sorry to disagree it is not your "right" to stick me with your healthcare bill because you choose not to be responsible! I'd love to spend the money it cost me for insurance ($600 per month for my family) and take a great vacation or buy new furniture BUT I'm not going to risk the health and safety of my family and stick my neighbors with my bills. You have rights under the constitution but they do not included treading on mine. It's sad that people want to rant and rave about "their rights" not caring how they affect others.
Finally common sense prevails and, you don’t HAVE to buy anything you don't want...just pay the penalty and you can roll the dice if anything happens. Also, try to get a "regular" doctor outside of the ER with reasonable fees if you or a loved God forbid gets into a car wreck or some other serious accident. That's when the money YOU CANT PAY BECAUSE YOU DONT HAVE INSURANCE is heaped onto your neighbors...come on you have to know this is wrong!
I wish half the people who scream SOCIALISM could even define what it means and then apply it correctly to their argument.

Congress created this problem when they made it against the law to turn people away from hospitals, if they didn't have the ability to pay.
Therefore, when you see ANY doctor and you can't pay for it. They pass the cost off onto anyone with an insurance policy. My wife has been an OR Nurse for the pass 20 years, when they have Patience's with insurance, they will open every item, even if they don't use them, just so they can recoup the cost for un-insured people.

The really "sad" part of this whole thing is to see people who need these benefits the most screaming and flapping their arms because somebody (I’m pretty sure 99.9% of them NEVER actually read the bill) told them it was SOCILISIM!! They will vote against their best interest if someone with a lot of money tells them it’s bad…because they can’t tell them they don’t want Obama raising their taxes!
I have great insurance, my family can go to the best doctors and be treated at anytime without us trying to decide if we can pay for food BUT a lot of people stand in long lines and wait months to have a tooth pulled. The very poor already have Medicaid so we're not giving them a free ride, but the person who works for a low wage getting up and going to work every day (not to mention the ones working for small companies) can't get insurance! When you worry that it takes food out of their kids mouth or it’s just flat not available through your employer, you aren’t mooching…these people work for God Sakes!
What is wrong with the people in this country? Did everyone forget the Christian principal (this country was founded on) of whatever you do for the least of your brothers...come on a little compassion here folks. I don't think everyone needs a "Cadillac plan" but basic expansion of Medicaid to help the working poor isn't too much to ask and if it cost you a little extra taxes just pray about it on Sunday and see if you can open a tiny place in your heart :)

I have very good insurance too - group insurance. And I have read to bill.
I am sure as hell am not going to let some politician DICTATE to me where my tax dollars go! Like I stated in my previous post, I am all for some kind of health care reform, but not at the cost of MORE AND MORE TAXES!
I am already taxed to death to where I only bring home after all deductions 60% of my actual pay (taxes taking the MAJORITY of that 60%!). I am not going to stand by and let MORE money come out of my pocket to pay for this. There has got to be a better way.

If there is a better way I'd love to hear it! The “public sector” GOP argument is sort of like “deregulate the banks and the market will police its self”…that worked out great for everyone :(
I'm not a liberal I've voted for the GOP many times over the years, and I’m sorry to say I think Obama is over his head. I am that 100% a swing vote. I really felt after these past four years I would be back with the GOP but Romney is not getting a vote from me! He is a flip flopper and if you believe the Romneycare guy is going to repeal anything you must be crazy!
I wanted a single payer system similar to Medicare...problem solved. It seems funny to me that older citizens who LOVE their Medicare don't want to share it with anyone else and rail against "government healthcare" while using the system successfully. Sounds like "I got mine you figure yours out on your own" Single payer is just Medicare for everyone and I never hear anyone, including my 84 year old Grandma, complaining. She loves Medicare it has taken excellent care of her! I've never had any issues getting her a doctor or access to the care she needs.

This is what I don't understand about people screaming about how this a take over of Health Insurance. Who do they think pays for the care, when they leave the Dr's office and give them the finger when the Bill comes, "EveryBody with Insurance"!!! If you lower the price, have people pay before the Dr see's them. I bet you'll have these same people taking about how immoral it is to turn people away from the Dr's office because they don't have any money

I don't think anyone has the answer to another way yet...I awaiting to see what happens and who says what. I know I just believe wholeheartedly that I can not afford ANY MORE TAXES coming our of my paycheck - especially for this fiasco!
On a side note: my brother received very good care through the Good Sam where he lives for OVER 10 YEARS until he was finally approved for SS and was eligible to receive Medicare and Medicaid. He received free meds, visits with doctors, heck even a few surgies thanks to that place. Don't tell me there isn't places folks can't go to get free healthcare now!

Have you ever seen the waiting list for those community places, and if you have a job making low wages how in the world do you take days off to stand in line and hope they see you?
Does anyone remember this story?… By the time the free health clinic at the Oakland Coliseum opened Saturday at dawn, some 800 tickets had been handed out to people who waited in the cold all night for the chance to have a tooth extracted, get new glasses or to finally get prescription medications for arthritis or other painful conditions
Is this really the country we want to live in?? Where people stand in line for up to 12 hours just to get a pair of glasses and rotten teeth pulled? I think we're better than that. If everyone bought insurance this wouldn’t be an issue. Call it a tax or whatever you want but those are just political words, at the end of the day we're talking about how we treat those people around us and it makes me sad to hear people say "I can't afford more" when they know there are people with a lot less.

A friend of my husband that lives in the UK (universal healthcare, right?) almost died what was at first a mild kidney infection..the doctors first available appointment was three weeks out. It got so bad, she went to the ER and they treated her, but not until her kidneys were severely damaged. Is this what we want in our country??

That is what's going on in this country! Hello...what do you think happens to people without insurance? They get no treatment and either become seriously (which means expensive for the tax payers) ill or die. I think unless people go around with their head in the sand they have to know medical insurance companies such as BC/BS Aetna and United HC are already "rationing services" and making people jump through hoops for care and prescriptions and that's IF you have insurance, if you don't well then it's even worse. I can't believe you haven't heard how insurance companies drop people during cancer treatments or won't allow them certain drugs or procedures because they are too expensive.
I know plenty of people from Canada and Europe and NONE of them (unless you know some very wealthy people who can afford to buy special care) would give up their Universal HC....just like no elderly people would give up Medicare. If it's so bad why do people who have it never want to give it up???

I should let you know I work for an insurance company (NOT HEALTH INSURANCE, -group life, disability) so I have a little inside information...not just want the "media" tells me that I need to believe.
I have lots of friends in the UK...most of them tell me they wish they had the QUALITY of care we have here. Just because someone has "Universal Health Care" doesn't mean they are getting the quality care they need. See my previous post...
And on another post..my brother. He received quality care WITHOUT INSURANCE or at the time he became ill or with Medicare/Medicade. There are options out there now...
Now, here is another question: who is gonna pay for this? Here you go. I more than fall into this category and I can not afford this!
