Passengers Admitted to Just Smoking Pot, Report Says

The police report from a June traffic stop where a man claims he was inappropriately touched by an officer says the two passengers admitted to smoking marijuana just prior to the stop.

Brice Wilson, a 23-year-old Villa Rica man, claims officer K. Moore inappropriately touched his genitals as he was being searched. are into the matter.

The report says a strong odor of marijuana was coming from the vehicle, which was pulled over at Atlanta Street and Old Austell Road for not having a working tag light.

As Wilson looked for his proof of insurance card, the passengers “would not make eye contact with me,” the report says.

When Wilson said he did not have proof of insurance, Moore told him to step out of the car and asked if he had any weapons. Wilson gave consent for a search, the report says.

“While conducting the pat down, I could feel the driver shaking with nervousness,” it says. “The odor of marijuana was very strong on the driver.” Wilson denied having any marijuana.

Moore requested for backup because Wilson was acting nervous, the smell of marijuana, and there were two people in the car, the report says.

“When I checked the front of his pants, Mr. Wilson grabbed my hand and began to fight with me,” the report says. “I placed Mr. Wilson in a chokehold because I didn’t want to go to the ground with the other two occupants in the car and not having backup.”

“While struggling with Mr. Wilson, Lt. Bailey arrived and helped me get Mr. Wilson to the ground and put handcuffs on him.”

Wilson continued to resist and tried to stick his hands down his pants, the report says. “Lt. Bailey eventually had to taser Mr. Wilson to get him to comply with our commands.”

Bailey has since resigned from the department, according to Fox 5. The resignation was unrelated to the incident, Police Chief Charlie Sewell told Fox.

No marijuana or weapons were found on Wilson, the two passengers, or in the car. But “the two passengers said that they had just came from a house where they had smoked marijuana,” the report says.
