Is It Time for Same-Sex Marriage?

Proponents and opponents of same-sex marriage are keeping their eyes this week on the Supreme Court justices.

The court on Tuesday began considering a challenge to California’s Proposition 8, a gay marriage ban approved by the state’s voters in 2008. Under the law, the state only recognizes a marriage if it is between a man and a woman.

Justices today are scheduled today to hear an appeal on a case against a portion of the federal Defense of Marriage Act, which was enacted in 1996. Section 3 of the act defines marriage as “a legal union between one man and one woman as husband and wife.”

The Associated Press reported that the justices may dismiss the case against Prop 8 without ruling on it, which would likely lead to same-sex marriages resuming in California but would not impact them anywhere else.
